Terms of Service

Welcome to Spotlist! These Terms of Service ("Terms") govern your use of the Spotlist mobile application and website (collectively, the "Service"), operated by Blue Dot Labs, LLC ("Spotlist," "we," "our," or "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility and Access
You must be at least 13 years old to use Spotlist. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update it as needed. One account per person; creating multiple accounts may result in termination.

3. User Content
3.1 What You Create
"User Content" means any content you submit through the Service, including restaurant lists, spot notes, dish recommendations, photos, check-in data, and profile information.
You retain ownership of your User Content. By submitting User Content, you grant Spotlist a worldwide, non-exclusive, royalty-free, sublicensable license to use, display, reproduce, distribute, and modify your User Content solely in connection with operating, promoting, and improving the Service. This license continues for a commercially reasonable period after you delete content or your account, to allow for the removal of cached or archived copies (typically no more than 30 days, except for backup systems which may take up to 90 days).
When you make your lists or check-ins public, other users may view, save, and share them within the Service. You control the visibility of your content through the privacy settings we provide.
3.2 Content Standards
Spotlist is a positive recommendation platform. You agree not to submit content that:
- Is defamatory, obscene, harassing, threatening, or hateful
- Infringes any third party's intellectual property, privacy, or other rights
- Contains spam, advertising, or promotional material not authorized by Spotlist
- Is intentionally false or misleading about a restaurant or establishment
- Impersonates any person or entity
- Contains malware, viruses, or other harmful code
- Violates any applicable law or regulation
We reserve the right to remove any User Content that violates these standards and to suspend or terminate accounts of repeat offenders.
4. Restaurant Information and Recommendations
Spotlist is a curation and discovery tool, not a restaurant directory. Restaurant details such as addresses, hours, and cuisine types are sourced from third-party services including Google Places. We do not guarantee the accuracy, completeness, or currency of this information. Always verify details directly with the restaurant before visiting.
Recommendations on Spotlist are personal opinions of individual users and do not constitute professional advice of any kind. Spotlist does not provide medical, nutritional, dietary, or allergen advice. If you have food allergies, dietary restrictions, or health concerns, you are solely responsible for confirming ingredients, preparation methods, and safety directly with the restaurant.
5. Taste Matching and AI Features
Spotlist uses algorithms to suggest taste-matched users and lists based on overlapping restaurant preferences, cuisine patterns, and similar signals. These suggestions are informational and are not endorsements. We strive for transparency in how matches are generated and will explain the basis for recommendations when possible.
Spotlist uses artificial intelligence services (large language models) to help parse and match restaurant names when you import lists from text or screenshots. Your imported text and images are processed by third-party AI providers solely for this parsing purpose and are not used to train AI models. See our Privacy Policy for details.
6. Third-Party Services
The Service integrates with third-party services that have their own terms:
- Google Maps Platform: Restaurant search and location data are powered by Google Places. Your use of this data is subject to the Google Maps/Google Earth Additional Terms of Service (https://maps.google.com/help/terms_maps/) and Google Privacy Policy (https://policies.google.com/privacy).
- Mapbox: Map displays are powered by Mapbox. See Mapbox Terms of Service (https://www.mapbox.com/legal/tos) and Privacy Policy.
- Apple Sign-In / Google Sign-In: If you use social login, the respective provider's terms apply to the authentication process.
We are not responsible for the practices or content of third-party services. Links to external sites (such as Google Maps for directions) are provided for convenience only.
7. Intellectual Property
The Service, including its design, features, branding, algorithms, and underlying code, is owned by Blue Dot Labs, LLC and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding without prior written consent.
7.1 Copyright Complaints (DMCA)
If you believe content on the Service infringes your copyright, send a notice to our designated agent at legal@spotlist.io with: (a) identification of the copyrighted work, (b) identification of the infringing material and its location on the Service, (c) your contact information, (d) a statement of good faith belief that the use is not authorized, and (e) a statement under penalty of perjury that your notice is accurate and you are authorized to act on behalf of the copyright owner.
8. Privacy
Your privacy matters to us. Our Privacy Policy, available at https://spotlist.io/privacy, explains how we collect, use, and protect your information. By using the Service, you consent to the practices described in our Privacy Policy.
9. Termination
You may delete your account at any time through the in-app settings. Upon deletion, we will remove your profile, lists, and associated content within 30 days. Backup copies may persist for up to 90 days before being purged.
We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if required by law. We will make reasonable efforts to notify you before termination unless doing so would compromise security or violate legal obligations.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure. We disclaim all liability for restaurant information provided through the Service, including information sourced from Google Places or other third parties.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUE DOT LAB LLC'S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100). WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
12. Dispute Resolution
Informal Resolution First. Before filing any formal claim, you agree to contact us at legal@spotlist.io and attempt to resolve the dispute informally for at least 30 days.
Governing Law. These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Arbitration. If we cannot resolve a dispute informally, you and Spotlist agree to resolve it through binding arbitration administered by JAMS under its Streamlined Arbitration Rules. Arbitration will take place in San Francisco, California (or remotely at your election). YOU AND SPOTLIST WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION OR CLASS ARBITRATION.
Opt-Out. You may opt out of this arbitration agreement by sending written notice to legal@spotlist.io within 30 days of creating your account. If you opt out, disputes will be resolved in the state or federal courts located in San Francisco, California.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email at least 14 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
14. General
If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will continue in full force. Our failure to enforce any right or provision is not a waiver. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Spotlist regarding the Service.
